Course Aim
The Project Execution Strategies course provides attendees with an understanding of the issues required to craft effective Project Execution Strategies. The course provides an overview of procurement law and how to effectively manage risk and opportunities in commercial agreements. The course provides perspectives from both the buy-side and sell-side with strategies to assist in early industry engagement, tender and bid development, and effective negotiations. The course explores novel procurement options including agile approaches, cost as an independent variable, and evolutionary acquisition along with more traditional procurement methods. No prior risk or contract knowledge is assumed.
Course Outline
Introduction: Overview of the elements of the Project Execution Strategy, Integration with the capability lifecycle, projects versus programmes.
Procurement Law Framework: Legislative frameworks, contract law basics, public versus private sector governance.
Engagement Strategies: Tender evaluation legal considerations, early engagement opportunities, crafting effective requests for tender, responding to tenders, Offer Definition and Improvement Activities (ODIA), parallel negotiation management, negotiation strategies for buyers and suppliers.
Risk Management: Risk and opportunity management in the procurement context, Complexity and Risk, Liability Risk Assessments, dealing with uncertainty, managing project contingency.
Procurement Methods: Linking the procurement model to the risk profile, traditional approaches (design only, design and Implement, Turn-key solutions), non-traditional approaches (Managing Contractor, Early Contractor Involvement, EPC, EPCM, PCM, and Alliances), novel options (spiral, agile, evolutionary)
Remuneration Strategies: Cost models (fixed price, variable price, incentive price, target cost, cost plus fixed fee), Performance Based Contracts, Cost as an Independent Variable (CAIV) approaches, risk-sharing strategies, Non-price incentives and dis-incentives.
Ownership and Funding Strategies: Co-funding options, Cooperative Programmes, Leasing Options; including dry and wet leases, Public Private Partnerships, taxation and depreciation considerations.
Change Management: Crafting contracts that effectively deal with emergence, managing waiver, election and estoppel, off-ramps, re-scoping, and termination.
Contract management: disputes and issues management, intellectual property management and licensing arrangements, insurance issues, bonds and guarantees.
Crafting Effective Project Execution Strategies: Linkages to strategy and business case, benefits realisation, updates throughout the capability lifecycle, integrating smart buyer workshops.
